Terms of Service

This document is a public offer (the "Agreement") from Backupy to any legally capable individual or legal entity (the "User") wishing to use the Backupy backup service (the "Service"). Registering an account is treated as full and unconditional acceptance of this offer (Article 438 of the Russian Civil Code).
1. Parties
Provider: Backupy. Legal entity details will be published after state registration. Contact: legal@backupy.ru.
User: any person who has registered with the Service and accepted these Terms.
2. Subject of the Agreement
The Provider gives the User remote access to the Backupy Service — a software and infrastructure system that automates backups of the User's Dockerised applications (Postgres, MySQL, MongoDB, Redis and other supported sources) into cloud storage located in the Russian Federation.
3. Registration and consent
- Registration is performed by providing an email address and password (or via supported OAuth providers: Yandex ID, GitHub, Google).
- By registering, the User confirms they have read and agreed to these Terms and the Privacy Policy.
- The User must provide accurate information and keep it up to date.
- Registration for persons under 18 requires consent of a legal guardian.
4. Free beta
At the time of publication, the Service is in open beta. During beta:
- The Service is provided free of charge.
- The Provider does not offer an SLA and does not guarantee uninterrupted operation, restore speed, or any specific level of availability.
- The Provider may change functionality, limits, or temporarily disable features at any time, with at least 14 days' notice by email.
- The transition to paid pricing will be announced separately and will not affect existing free backups within the grace period.
5. User obligations
The User agrees to:
- use the Service in accordance with Russian Federation law;
- not use the Service to store or transmit material whose distribution is prohibited by law (including extremist content, content infringing third-party copyrights, etc.);
- keep credentials (passwords, session tokens, API keys) confidential and immediately notify the Provider of any unauthorised access;
- safely store the encryption keys used to encrypt backups. Losing the key makes the backups undecryptable — the Provider does not hold a copy and cannot recover it.
6. Security and data integrity
Backups are encrypted on the User side (Backupy agent) before upload (end-to-end encryption). The Provider has no technical ability to read backup contents.
Despite reasonable precautions (storage redundancy, integrity checks, monitoring), Users are strongly advised to periodically test restores to verify that backups are functional.
7. Termination
Either party may terminate this Agreement at any time:
- User: by deleting the account in the Service UI or notifying support@backupy.ru in writing. Data is removed after a 30-day grace period (see the Privacy Policy, § 5).
- Provider: if the User violates these Terms — by suspending or deleting the account, with prior notice (except for severe violations, where suspension may be immediate).
8. Limitation of liability
The Service is provided "as is". During the free beta the Provider bears no liability for direct, indirect or consequential losses incurred by the User, including but not limited to:
- loss or corruption of User data (including inability to restore a backup);
- lost profits;
- business interruption.
Liability terms for the commercial version (after Phase 3 of the development plan) will be set out in a separate contract.
9. Intellectual property
The Backupy agent source code is published under an open-source licence (see the project repository). All other components of the Service (web UI, backend, documentation, the Backupy trademark) are the intellectual property of the Provider and protected under Russian copyright law.
The contents of User backups remain the User's exclusive property. The Provider acquires no rights to them.
10. Governing law and disputes
This Agreement is governed by the law of the Russian Federation. Disputes must first be addressed through good-faith negotiation. If no agreement is reached, disputes are resolved by the court at the Provider's location, in accordance with Russian procedural law (Article 432 of the Civil Code and following).
11. Changes
The Provider may amend these Terms. Material changes take effect 14 days after publication on this page and an email notification to registered Users. Continued use of the Service after the effective date constitutes acceptance of the updated version.
